1. Scope

These Terms and Conditions apply to all orders and commissions between Mirisan and its customers made via the website, by e-mail, or through other communication channels.

2. Services & Uniqueness

Mirisan creates handmade individual pieces and small series. Minor variations in colour, material, or craftsmanship are inherent to the handmade process and do not constitute defects.

3. Offer & Order

Product images are for illustrative purposes only. An order is considered accepted once it has been confirmed by Mirisan in writing (e.g. by e-mail or WhatsApp).

4. Prices & Payment

All prices are in CHF. Shipping costs are listed separately.

All goods remain the property of Mirisan until full payment has been received.

5. Personalisation & Approvals

For personalised items (e.g. names, logos, special sizes), design drafts may be provided for approval. Once approved, the customer confirms both the content and execution. Any later changes may result in additional costs.

6. Production Time & Delivery

Production time is communicated individually. Delivery times begin after payment has been received and any required approvals have been confirmed.

Shipping:

Switzerland: via Swiss Post
Germany/Italy: also via Swiss Post; shipping costs depend on parcel size and weight and will be communicated in advance.

The transport risk passes to the customer once the parcel is handed over to the postal service.

7. Returns & Right of Withdrawal

For custom-made or personalised products, returns are not possible.
Non-personalised, unused items may be returned within 7 days of receipt after prior agreement. The return shipping costs are borne by the customer.

8. Defects & Warranty

Complaints regarding visible defects must be submitted in writing within 5 days of receipt (including photos). In the case of justified complaints, Mirisan will offer repair or replacement. Further claims are excluded to the extent permitted by law.

9. Care Instructions

Please follow the provided care and usage instructions. Mirisan is not liable for damage resulting from improper use or handling.

10. Copyright & Use

All designs, patterns, images, and texts remain the intellectual property of Mirisan. Any use or reproduction requires prior written consent.

11. Notice for international orders:

For deliveries outside Switzerland, customs duties and import taxes may apply.
These charges are set by the customs authorities of the destination country and are not included in the shipping costs.
The exact amount varies by country and is beyond my control.
Please check with your local customs office for details on possible additional charges.

12. Liability

Mirisan is only liable for damages caused intentionally or through gross negligence. Any further liability is excluded to the extent permitted by law.

13. Data Protection

Personal data is processed in accordance with the Privacy Policy and will not be shared with third parties.

14. Amendments to the Terms

Mirisan may amend these Terms at any time. The version valid at the time of the order shall apply.

15. Applicable Law & Jurisdiction

Swiss law applies. The place of jurisdiction is Dotzigen, Canton Bern, unless a mandatory legal jurisdiction applies.
